Although a ruling was expected from Judge Timothy J. Kelly today on CNN’s lawsuit against the Trump Administration, both sides have now been told that they will have to wait until the next hearing scheduled for Friday at 10 a.m.
CNN is seeking a temporary restraining order and preliminary injunction that would see their reporter, Jim Acosta, who was banned from the White House, have his pass temporarily reinstated. The request for “emergency relief” is based on CNN’s claim that Acosta’s first amendment rights are being violated by denying him access to the White House.
CNN is also seeking “permanent relief,” which, if granted, could protect Acosta and other journalists from a similar White House ban. Further hearings are expected to take place in the coming weeks to determine if this type of ban is indeed unconstitutional.
Yesterday’s hearing saw a very thorough Judge Kelly drill into both side’s arguments with multiple questions. His preliminary ruling is expected tomorrow and we will update this post with his decision once made.
