Senior Trial Attorney, Scott D. Nelson, who leads Callahan & Blaine’s Labor and Employment Department, recently published an engaging article on the Dynamex case in the Los Angeles Daily Journal.
In the article, Nelson proposes four key ramifications of the decision and concludes that the Dynamex case is about more than Wage Orders, since it provides significant guidance as to how employment status is to be determined under any statute or regulation. Nelson points to it being a further extension of the decision in Ayala v. Antelope Valley Newspapers Inc., (2014), a Supreme Court case in which Nelson successfully argued to the Supreme Court for an important precedent in protecting the rights of California’s workers.
Along with Nelson’s victory in the Ayala case, Scott has successfully conducted five trials and arbitrations in the last several years. His most recent trial success was a victory in a class action securities litigation, after a one month in trial in Los Angeles.
If your business needs advice about the best ways to approach and resolve complex employment litigation, Mr. Nelson can be reached by phone (888) 894-1703 or email.
