A woman discovered her husband was killed in a car crash in Aliso Viejo last Wednesday morning when she happened to come upon the scene. A suspected hit-and-run driver has now been arrested.

Rogelio Martinez Cuin, 38, was taken into custody after authorities responded to the crash site near Woods Canyon Drive and Westridge Drive about 6:40 a.m. and discovered the victim, 51-year-old Michael David Tomlinson.

According to police, Tomlinson was riding his bicycle when he was hit by Cuin. Tomlinson was rushed to a nearby hospital, where he was pronounced dead.

The suspected driver and a vehicle believed to be involved in the crash were found a short distance from the scene. The Orange County Sheriff’s Department stated that the vehicle was less than a mile away and the suspect was found on a nearby trail.

Cuin, a resident of Lake Forest, is now being held at Orange County Jail on suspicion of felony hit-and-run and vehicular manslaughter.

The O.C. Sheriff’s Department stated that the victim’s wife had discovered Tomlinson was involved in the crash after first coming upon the scene and finding him.

Officials do not believe drugs or alcohol were involved in the crash.
